Touch the Water Waiver and Guidelines

Welcome Aboard! We’re thrilled to have you join us for an unforgettable experience aboard the Palapa Boat or Aqua Taxi! Our mission is simple: to provide a fun, safe, and memorable outing for all guests. To ensure this, we ask everyone to follow a few essential rules and acknowledge the terms outlined below. Please read the whole document before submitting. 

**Individual Responsibility Each adult passenger must sign this waiver independently. By boarding the vessel, all passengers agree to comply with the terms outlined in this document. Those who have not signed the waiver will be asked to do so prior to the start of the cruise.

Passenger Guidelines

1. Identification & Sobriety

• All passengers may be asked to  present valid government-issued identification.
• Any person arriving in an intoxicated condition will not be allowed to board. No exceptions.

2. No Glass Containers

• Glass is strictly prohibited onboard. Please use cans or plastic containers for your beverages.

3. Captain’s Authority

• The captain is in charge of the vessel at all times, and their decisions are final.
• The captain has the authority to address any unsafe or disruptive situations.

4. Passenger Behavior The following behaviors are prohibited and may result in removal from the vessel or immediate termination of the tour:

• Intoxication beyond reasonable limits
• Foul language or offensive gestures
• Excessive noise or disruptive conduct
• Public urination
• Arguing or fighting
• Creating danger or hazards to others
• Littering
• Unauthorized swimming
• Smoking or vaping onboard
• Moving about while the boat is underway
• Damaging property (Palapa Boat, Aqua Taxi, or any public/private property)

5. Tour Termination & Behavior/Damage Fees

• The captain may end a tour at any time if passenger behavior presents a safety concern.
• A $300 behavior/damage fee may be charged to each offending passenger’s credit card.

6. Alcohol Rules & Responsibility

• All local laws and onboard alcohol policies must be followed.
• Responsible drinking is encouraged—this is a fun cruise, not a booze cruise.

7. Promotional Use

• By participating in a tour, passengers grant Palapa.Tours and Aqua Taxi permission to use photos or videos of the experience for promotional or informational purposes.

Liability Waiver

I, the undersigned passenger, acknowledge and accept that participating in a tour aboard the Palapa Boat or Aqua Taxi includes inherent risks, including but not limited to:

• Inclement weather
• Contact with other vessels
• Tripping or falling
• Falling from the vessel

I understand that these risks can result in serious injury, death, or property damage, and that such risks cannot be eliminated without altering the unique nature of the tour.

I accept full responsibility for my personal safety and the safety of others around me. I further release Palapa.Tours, Aqua Taxi, and their affiliates, staff, and partners from liability for any injuries, damages, or losses incurred—even if caused by negligence.

I understand that no medical personnel may be present onboard, and that emergency response may be limited.

Release of Liability

To the fullest extent permitted by law, I waive and discharge all claims, and release from liability Palapa.Tours, Aqua Taxi, and all related parties ("Released Parties") for any personal injury, death, or property damage related to my participation in a tour, including but not limited to:

• Negligent operation or supervision of the vessel
• Negligent maintenance of equipment
• Negligent response in emergencies

This release is binding upon my heirs, executors, administrators, and assigns.

Proprietary Rights

The Palapa Boat and the Solar Aqua Taxi's are a proprietary design. By boarding, you agree not to replicate or commission a similar vessel for any personal or commercial use.

Final Acknowledgment I acknowledge that I have read and understood this Waiver and the accompanying Guidelines. I voluntarily accept these terms and agree to be bound by them.

This waiver applies to all passengers aboard any vessel operated by Palapa.Tours and/or Aqua Taxi under the Touch the Water experience. By providing the information below, I accept and acknowledge the conditions as stated.
